Did Black Lives Matter Violate Adidas' Copyright for the Three-Stripe Logo?

Trademark

Adidas is taking legal measures against Black Lives Matter due to their logo.

The organization known as BLM has utilized a logo showcasing three stripes encompassing the accompanying text, and they still use it presently.

Black Lives Matter is currently trying to register a trademark for its logo that features three stripes. This logo has already been utilized on items and in promotional content.

Josh Gerben, an attorney specializing in trademarks, shared a series of tweets revealing that Adidas has initiated legal proceedings to prevent a certain attempt.

Adidas, the well-known sports clothing brand, has argued that people could mistakenly believe that products and services associated with the BLM trademark are either endorsed or affiliated with their company.

According to the submitted document in the court, it is mentioned that:

Adidas holds a higher degree of importance regarding the usage of the "Three-Stripe" trademark.

Secondly, customers may incorrectly assume that the products and services provided by BLM's trademark have a connection to or endorsement from Adidas.

Moreover, they claim that BLM uses the stripes in a comparable way and that "The products and services provided by BLM with their proposed trademark are the same as or very closely related to the products Adidas offers."

In the filing, it is stated that in the event that BLM's trademark is granted, it will cause significant damage to Adidas, as it will reduce the association that consumers have between the Three-Stripe Mark and Adidas.

Can Adidas Legally Pursue a Lawsuit Against Black Lives Matter Movement?

The financial practices of the Black Lives Matter organization are not well-regarded.

Gerben is not sure about the level of Adidas's case in this situation.

He stated that the varying directions and hues of the lines could pose a challenge when attempting to secure a successful filing.

Check out: Grant Napear, a broadcaster who got fired due to his tweet saying 'All Lives Matter' is getting ready to face his trial. He claims that he was unfairly punished and sacrificed for standing his ground.

The area of trademark law is widely known to be extremely challenging to comprehend, and judgments can be uncertain.

Throughout their entire history, the three stripes have been a clear symbol of Adidas. However, the stripes of BLM are uniform in size, which is different from Adidas's stripes, gradually becoming smaller. In addition, the yellow color used may create difficulty in making a clear distinction.

Adidas showed a contrast between their products and those sold by the BLM store. The outcome of the evaluation justified their decision to pursue the legal action.
