Dani Alves trial: Ex-Brazil player guilty of nightclub rape

A Spanish court has declared that Dani Alves, a former football player for both Barcelona and Brazil, has been convicted of sexually assaulting a woman at a nightclub in Barcelona.

He got punished with a jail term of four and a half years.

The individual, aged 40 and highly accomplished in the sport of football, had refuted allegations of the sexual assault of a woman on the morning of December 31st, 2022.

The attorney representing him requested that he be found not guilty, and Alves has the option to challenge the verdict by making an appeal.

In addition to giving Alves a prison term of four and a half years, the court also mandated him to provide €150,000 (£128,500) in compensation to the individual. Furthermore, Alves is required to undergo five years of probation post-release.

Alves and his buddy were accused of buying champagne for three young females. Afterwards, they convinced one of them to follow them to a VIP area of the club using a restroom she was unaware of. The prosecutors mentioned this in the case.

They contended that it was at this juncture when he became aggressive, pressuring the woman to engage in sexual intercourse despite her persistent plea to go away.

Alves had claimed that she had the choice to depart "if she desired." Nevertheless, the tribunal determined that she did not give her agreement.

The court issued a statement affirming that aside from the victim's testimony, there were other pieces of evidence indicating that she was sexually assaulted.

According to the report, Alves forcefully seized the victim and forcefully threw her to the ground. He proceeded to sexually assault her while holding her down, despite the fact that she clearly expressed her disapproval and made it evident that she wanted to depart.

The lady expressed that the assault had brought on her significant distress and fear, and one of her companions who was present with her that night shared how the 23-year-old had cried inconsolably once she left the washroom.

Alves has been in jail before going to trial since January 2023 and has contradicted himself multiple times while testifying.

Initially, he refused to acknowledge his accuser and denied ever having knowledge of her. However, he later changed his statement and confessed that he had actually encountered her in the bathroom. However, he made it clear that their meeting did not involve anything significant between them.

Later on, he altered his account of what happened and claimed that both parties engaged in a consensual sexual act. The person in question stated that they were both experiencing pleasure during the encounter.

The officials looking over the case suggested that the offender be put behind bars for nine years. In Spain, any allegations of sexual offense are thoroughly examined as a whole and those who are found guilty could spend four to 15 years in jail.

In recent times, the legislation has been altered to establish the significance of giving consent according to the principle of "Only Yes is Yes."

Alves participated in over 400 games for Barcelona and triumphed in six league titles and three Champions Leagues throughout two periods with the team. Additionally, he served as a member of Brazil's 2022 World Cup roster.
