A woman has filed a lawsuit against American performer Jamie Foxx with claims that he sexually attacked her at a dining establishment in New York City nearly a decade ago.
As per the legal claim, Mr. Foxx, whose name is actually Eric Marlon Bishop, allegedly touched the unidentified lady inappropriately when she requested to snap a picture with him.
Mr. Foxx is being taken to court by the person making the accusation for compensation, claiming that he committed "sexual assault, mistreatment, physical attack, and battery".
A spokesperson for the performer affirmed that "the purported occurrence did not occur."
On Thursday, the representative gave a statement to Deadline, mentioning that the lady had taken legal action before in Brooklyn about three years ago with comparable allegations, but it was rejected.
Our team is certain that the case will be dismissed once more. If that happens, Mr. Foxx plans to take legal action against the individual and her legal representatives for bringing this baseless lawsuit and wasting everyone's time.
The BBC has contacted the representatives of Mr. Foxx to receive a statement.
According to the lawsuit, the attack happened at Catch NYC around 1:00 am on August 26, 2015. The lady was sitting at a table adjacent to Mr. Foxx when the incident took place.
According to the lawsuit, the performer seemed to be under the influence of alcohol and consented to a snapshot by saying, "of course, darling, I'll do anything for you."
Additionally, it is mentioned that he informed the lady that she possessed a physique similar to that of a supermodel and had a delightful aroma.
According to the legal case, he guided her towards a private section of the eating establishment and groped her chest. He also invaded her undergarments with his hands, all without her permission. The occurrence eventually stopped when her companion arrived to search for her.
The legal case is also pursuing compensation from Mark Birnbaum, the proprietor of the eatery and pub, who the plaintiff claims was sitting with Mr. Foxx shortly before the supposed attack happened.
The lawsuit alleges that Mr. Birnbaum and the staff at the restaurant did not fulfill their responsibility to take care of the woman by not keeping her safe.
Mr Birnbaum did not provide a comment to the BBC when asked on Wednesday evening.
According to the lawsuit, due to the terrible deeds committed, the woman has undergone and is still undergoing intense mental pain and anxiety, public shame, humiliation, post-traumatic stress syndrome, and several other bodily and psychological injuries.
The lawsuit was filed just a few days before the termination of the New York Adult Survivors Act, a law that gives supposed victims of sexual offenses the right to file lawsuits after the set time limit has expired. This law will be terminated on November 24.
The act has been utilized to sue various high-profile individuals, including former US President Donald Trump, rapper Sean Combs, comedian Bill Cosby, actor Cuba Gooding Jr, and Russell Brand.
In the year 2004, the film Ray portrayed Mr Foxx's excellent acting skills, particularly in his portrayal of the pianist Ray Charles. As a result of his exceptional performance, he received the prestigious Best Actor Academy Award.
