The decision made by the Bucharest Court of Appeal presents a significant challenge for Romania's anti-organized crime agency, which is required to take action within the next five days.

The appeals court also instructed that certain pieces of evidence be excluded.

The announcement follows almost two years after Andrew Tate, 37, and his brother Tristan Tate, 36, were taken into custody with two Romanian women close to the capital.

Last year, Romanian prosecutors officially charged all four individuals.

In April, the Bucharest Tribunal announced that a trial could commence, although a specific date was not established.

All four of them reject the claims completely.

"This is a significant win for our clients, who have consistently proclaimed their innocence from the start," stated Eugen Vidineac, one of the attorneys representing the brothers.

"The court's ruling to dismiss important evidence and require changes to the charges shows that there are insufficient valid accusations against them."

Prosecutors did not release any immediate comments.

The appeals court determined that there were several issues with the prosecutors' case against the Tates. They noted that the prosecutors did not sufficiently clarify the charges against Andrew to one of the alleged female victims, and that the charges against the female suspects were not effectively communicated.

The indictment did not clarify the specific amounts involved in the asset seizure linked to the case.

The court instructed that certain pieces of evidence be excluded, including testimonies from two supposed victims and statements given by Andrew and Tristan, as they were considered not acceptable in the case.

The court did not provide a reason.

Following the verdict, Andrew Tate, a former kickboxer with dual British and American citizenship and more than 10 million followers on X (previously known as Twitter), remarked: "The prosecutors were aware these were falsehoods. We recognized they were falsehoods too."

In August, the organized crime agency DIICOT initiated a second investigation into the Tate brothers, focusing on accusations including human trafficking, trafficking minors, sexual relations with a minor, tampering with evidence, and money laundering.

They have rejected all the accusations. The decision made on Tuesday has no impact on this case.

In March, the Tate brothers were present at the Bucharest Court of Appeal for a different matter after British officials released arrest warrants related to accusations of sexual assault from a case in the UK that dates back to between 2012 and 2015.

The appeals court approved the UK's demand to extradite the Tates, but this will happen only after all legal matters in Romania have been resolved.
